5 NIGHTS IN IBIZA IN ALL INCLUSIVE

1. Organizing company

The organization of the draw is promoted by TOJUACA IBIZA S.A with CIF A07711948 and registered office at Av. Ignacio Wallis no. 21 4º, 07800 Ibiza, hereinafter and indistinctly the ORGANIZER.

 

2. Particular bases

The requirements to participate will be those described in the material intended for the promotion of the raffle and that will be detailed later, and will include the necessary information in relation to the duration, form of participation, cost of participation, as well as the location of the bases. general participation.

The ORGANIZER reserves the right to make the modifications or add the annexes to these Bases in relation to its mechanics and prize, which it considers pertinent as long as they are justified, do not harm the participants, are carried out within the validity period of the promotion and are published in the same medium as those present.

 

3. Acceptance of the bases

Participation in this raffle implies full and unconditional acceptance of these general and particular bases that the ORGANIZER establishes. Recognition as a valid participant is subject to compliance with the requirements established in point number 4 of these general bases.

The ORGANIZER reserves the right to disqualify participants who do not comply with them and/or who go against these rules.

4. Participation requirements

Participation will be completely free, without the need to purchase any product or pay a fee to participate.

Participants must be over 18 years of age, have a residence in European territory, and meet the participation requirements described below:

It must be a natural person (being automatically excluded those users who are not real or assume a false identity)
Being a follower of the Instagram account @azulinehotels
Make as many comments as you want in the giveaway publication mentioning a person with whom you would like to share the prize. Only one person is allowed for each comment made.
Both participants and their companions must have a legal and valid identification document
Do not use this promotion to: disseminate political or religious ideas; promote insults or slander against third parties; use violent, obscene or offensive language; and/or publish content other than the object of the mechanics of the promotion.
Fully and unreservedly accept the present bases of participation. These legal bases intend that the draw between the different participants be done with equal opportunities and with strict respect for the rules of good faith. For this reason, any abusive or fraudulent use of these bases will lead to the consequent disqualification of the participant. In the case of detecting irregularities in the behavior of the participants, the ORGANIZER will be forced to eliminate the participant. The ORGANIZER also reserves the right to eliminate all those participants who are false or of dubious origin based on Instagram profile standards. In case of verifying irregularities after the acceptance of the prize, the ORGANIZER reserves the right to exercise all legal actions that assist it against the offenders. In any case, participants who do not meet the participation requirements set forth in these rules will be disqualified.
All azuLineHotels employees and people directly related to them (parents, children, siblings, cousins, partners...) are excluded from participation.

 

5. Draw start and end dates

The starting dates for participation in this draw will begin on February 29th, 2024 and its completion will be on March 15th, 2024. Likewise, the deadline for participation in the draw will be announced through promotional material of the same.

 

6. I use Instagram as a giveaway platform

By accepting these Bases, the participants disassociate themselves from any claim that they could raise during the development of the promotion, and accept that Instagram is only a completely independent platform of the promotion with the sole purpose of being used as a means of dissemination and promotion of the lottery.

Instagram does not in any way endorse or administer the promotion, nor is it associated with it. The information that the participants provide, they do so to the ORGANIZER and not to Instagram. The information of the participants will only be used for the cases provided for in these Bases.

 

7. How the draw works

Participation will take place through the Instagram platform, therefore it will be essential that the participants are users of it, as well as followers of @azulinehotels.

The draw participation mechanism will be as follows: @azulinehotels will post an image on their profile communicating the draw, where users who want to participate must name the person in the comments available at the bottom of this promotional image.

Users can participate as many times as they want, commenting and mentioning a person for each comment posted. The number of comments will not influence the final result of the draw.

The winner will be chosen from among all the contestants through the use of computer applications.

 

8. Winner Draw

After the draw has been carried out, the ORGANIZER will verify that the winner of the draw meets all the requirements established in these Bases and that they can be declared winners. To do this, the ORGANIZER will contact the winning user of the draw by private message (DM).

They must respond by private message on Instagram within a maximum period of 4 hours from when the organizer has contacted them and must respond with the following information:

Conformity and express acceptance of the prize or equally express waiver of the same (conditional or limited acceptances will not be valid). In the case of resignation, it will not be necessary to submit the data and documents indicated in the following points: - Legal and valid Identification Documents. If the chosen person renounces the prize, does not answer, or does not meet the initial requirements to be declared the winner, the ORGANIZER will contact the first substitute or, where appropriate, the successive substitutes up to a maximum of ten (10) for the purpose of proposing the prize. prize and (if you do not waive or omit response in turn) verify compliance with the requirements and follow the steps for the declaration of winner that have been indicated. Once the maximum number of substitutes has been reached, since all have resigned or do not meet the requirements established in these Bases, the ORGANIZER may declare the draw void.
Once it has been verified that all the requirements established in the Bases are met, the ORGANIZER will also communicate by message and/or by email the declaration of winner of the raffle to the lucky user. The ORGANIZER may publish the final winner of the draw through its Instagram page.
It is considered NO acceptance of the prize and, therefore, waiver of it: • If, at the time of making the prize effective, it is verified that the data provided by the participant is false or does not correspond to their real data. • If at any time a breach of the participation requirements included in these Bases is discovered. • If at any time it is discovered that the winner has incurred in any of the causes of disqualification included in these Bases. • If the prize is not accepted within the indicated periods.
The resignation of the prize will not give the right to any indemnity or compensation.
The winner will be responsible for any fiscal or tributary charge that acceptance of the prize may entail, as well as any other expense derived from the promotion that is not expressly assumed by azuLinehotels in these Legal Bases.


9. Prize

The draw will include nights of accommodation for two people at any azuLinehotels hotels based on availability.

The accommodation will be chosen by the ORGANIZER, in any of the azuLine hotels determined, and both the place and the dates for the accommodation can be modified based on availability.

The prize does not include travel to the hotel to be determined, only accommodation under the conditions set forth herein.

The prize will be made in accordance with the following conditions: 1. The prize may in no case be subject to change, alteration or compensation at the request of a winner; 2. The prize is non-transferable; 3. It is not exchangeable for other products or for any financial compensation.

The name of the winner may be published on the different digital platforms of the ORGANIZER, such as its website or its page on Instagram, in accordance with the data protection and transfer of image rights clause of these Bases. The raffle acceptance mechanism will individually notify the winner once it is officially declared.

 

10. Contact and claims

Participants can contact the organizer through the following email: juridico@azulinehotels.com, where they can also be addressed for any questions or claims that may arise as a result of this draw.

 

Participants will have a period of 15 calendar days, from the day the winner of the draw is known, to file a claim if they consider it appropriate.

 

11. Processing of personal data

 TOJUACA IBIZA S.A. In accordance with the provisions of current regulations on the Protection of Personal Data, informs that the data will be incorporated into the treatment system owned by TOJUACA IBIZA S.A. with CIF A07711948 and registered office at AVDA. IGNACIO WALLIS, 21, 3º 07800, IBIZA (ILLES BALEARS), in order to facilitate, expedite and fulfill the commitments established between both parties, and related to participation and holding of the draw.

In compliance with current regulations, TOJUACA IBIZA S.A. informs that the data will be kept for the period strictly necessary to comply with the precepts mentioned above.

With this clause they are informed that the data will be communicated if necessary to: banks and savings banks, public administrations and all those entities with which communication is necessary, in order to comply with the provision of the aforementioned service. The fact of not providing the data to the aforementioned entities will imply that it is not possible to continue with the participation in the draw.

Until the contrary is communicated, it will be understood that the data has not been modified, both entities undertake to notify any variation, granting their consent to use them for the aforementioned purposes.

 

For their part, TOJUACA IBIZA S.A informs that they will proceed to treat the data in a lawful, loyal, transparent, adequate, pertinent, limited, exact and updated manner. That is why TOJUACA IBIZA S.A undertakes to adopt all reasonable measures so that these are deleted or rectified without delay when they are inaccurate.

 

In accordance with the rights conferred by the current regulations on data protection, you may exercise the rights of access, rectification, limitation of treatment, deletion, portability and opposition to the treatment of your personal data as well as the consent given for the treatment of the same, directing your request to the postal address indicated above or to the email juridico@azulinehotels.com.

 

In the same way, you can go to the competent Control Authority to present the claim that you consider appropriate.

 

The Organizer (azuLine) may declare the draw as Void due to unforeseen events that cannot be controlled by the Organizer, as well as interruptions in the normal functioning of the Instagram platform itself or in the event that the Organizer detects malpractice that determines that there is some alteration due to third parties.

 

12. Governing Law and Jurisdiction

Promotional actions are governed by Spanish law.

The ORGANIZER, and the participants in the promotion, expressly waiving any other jurisdiction, submit to the courts and tribunals of Ibiza for any dispute that may arise from this draw.
